Differences in Plaintiff Win Rates in Judge and Jury Trials

Step 1

Use the Judicial Statistical Inquiry website to obtain information, over some selected time period, about one or more of
the following:

  • a) the number of judge and jury trials won and lost by plaintiffs in federal court in
    product liability cases (case category number 365 on the website);
  • b) the number of judge and jury trials won and lost by plaintiffs in federal court in
    general contract cases (case category number 190 on the website); or
  • c) the number of judge and jury trials won and lost by plaintiffs in federal court in
    employment discrimination cases (case category number 442 on the website).

You have to read the Judicial Statistical Inquiry form carefully to understand what you are getting back from it. For example, if you see as output the following:

then that means the win rates are 41% and 28%; N is the number of judgments, whether for P or D.
